These Terms & Conditions ("Terms") govern your access to and use of the Untamed South website and your purchase, installation, possession, or use of products sold by Untamed South LLC ("Untamed South," "we," "us," or "our"). These Terms apply to all products offered, manufactured, assembled, modified, distributed, or sold by Untamed South, including current products and products introduced in the future. Products may include, without limitation, marine accessories, throttle and cruise-control products, engine-control accessories, push-button start systems, remote-start systems, electrical or electronic accessories, hunting equipment, outdoor equipment, vehicle accessories, recreational equipment, apparel, accessories, and other products developed or sold by Untamed South. Product-specific instructions, warnings, specifications, and documentation provided with a particular product are incorporated into these Terms and apply to that product. By accessing our website, placing an order, purchasing a product, installing a product, or using a product purchased from Untamed South, you acknowledge that you have read, understood, and agreed to these Terms.
If you do not agree to these Terms, do not purchase, install, modify, or use Untamed South products.
1. IMPORTANT PRODUCT NOTICE
Untamed South products are aftermarket, recreational, hunting, outdoor, marine, vehicle, mechanical, electrical, and/or electronic products and accessories, depending on the specific product.
Certain Untamed South products may interface with or modify the operation of boats, engines, throttles, ignition systems, starting systems, electrical systems, vehicles, hunting equipment, machinery, or other equipment.
IMPROPER INSTALLATION, IMPROPER USE, FAILURE TO INSPECT A PRODUCT, UNAUTHORIZED MODIFICATION, USE OF AN INCOMPATIBLE PRODUCT, OR USE OF A DAMAGED OR MALFUNCTIONING PRODUCT MAY RESULT IN PROPERTY DAMAGE, LOSS OF CONTROL, EQUIPMENT FAILURE, SERIOUS INJURY, OR DEATH.
The customer is responsible for determining whether a product is appropriate and compatible with the customer's particular equipment, vehicle, vessel, engine, electrical system, hunting application, or other intended application.
The customer must read and follow all applicable installation instructions, operating instructions, warnings, specifications, and manufacturer recommendations before installing or using any Untamed South product.
2. PRODUCT-SPECIFIC INSTRUCTIONS AND WARNINGS
Products may have different installation, operating, maintenance, and safety requirements.
The customer agrees to review and follow all product-specific installation instructions, operating instructions, warnings, specifications, compatibility requirements, maintenance and inspection requirements, manufacturer instructions for the equipment on which the product is installed, and any other documentation provided by Untamed South.
Where product-specific instructions conflict with general information contained in these Terms, the product-specific instructions shall control with respect to that particular product, to the extent permitted by applicable law.
Untamed South may provide additional warnings or instructions for individual products as necessary.
3. CUSTOMER ACKNOWLEDGMENT AND ASSUMPTION OF RISK
By purchasing or using an Untamed South product, you acknowledge that certain recreational, hunting, marine, vehicle, mechanical, electrical, and outdoor activities involve inherent risks.
Depending on the product and its intended application, such risks may include loss of control, sudden acceleration or deceleration, equipment malfunction, electrical malfunction, engine malfunction, unexpected starting or movement, mechanical failure, improper installation or adjustment, operator error, collision with objects, vessels, vehicles, structures, or persons, exposure to water, weather, terrain, or environmental conditions, injury to the operator, passengers, bystanders, or other persons, property damage, serious bodily injury, and death.
You voluntarily accept the ordinary risks associated with the activity and equipment for which the product is intended.
This acknowledgment does not eliminate any rights or protections that cannot legally be waived.
4. INTENDED USE
Untamed South products are intended only for their stated purpose and compatible applications described by Untamed South.
Products must not be used for an application for which the product was not designed, installed on incompatible equipment, modified without authorization where such modification may affect safety or operation, used in a manner inconsistent with product instructions, used if damaged, worn, loose, improperly adjusted, or malfunctioning, used after a safety-critical component has been modified without appropriate evaluation, used in a manner that violates applicable law, or used as a substitute for safe operating practices or applicable manufacturer requirements.
The customer is responsible for confirming compatibility and suitability before purchase and installation.
If you are uncertain whether a product is compatible with your equipment or intended application, contact Untamed South before purchasing or installing the product.
5. INSTALLATION REQUIREMENTS
Where installation is required, installation must be performed in accordance with the instructions supplied with the applicable product.
The customer is responsible for ensuring that installation is performed correctly.
After installation and before normal operation, the customer should verify all applicable functions described in the product-specific instructions.
Depending on the product, this may include verifying that components are properly installed and secured, fasteners and attachment points are properly secured, mechanical components move through their intended range, electrical connections are properly connected and insulated, controls operate as intended, safety mechanisms operate as intended, the product does not interfere with the original equipment's safety systems, the equipment operates normally, the product does not create unintended movement or operation, and any applicable emergency, manual, or original-equipment controls remain functional.
If a product does not operate exactly as intended, do not continue using it until the issue has been identified and corrected.
6. ELECTRICAL, ELECTRONIC, STARTING, AND CONTROL PRODUCTS
Certain Untamed South products may interact with electrical, electronic, control, or other powered systems.
These products may include, without limitation, ignition accessories, electrical control accessories, wiring harnesses, switches, controllers, sensors, control modules, and other electrical or electronic accessories.
Installation of these products may affect the operation of the original equipment.
The customer is responsible for confirming compatibility and ensuring proper installation.
Do not use a product if its installation results in unintended starting, movement, electrical behavior, loss of a safety function, or other abnormal operation.
Where applicable, the customer must ensure that the original equipment's manufacturer-required safety systems remain operational.
7. INSPECTION AND MAINTENANCE
The customer is responsible for regularly inspecting Untamed South products and their installation.
Inspection should include, where applicable, fasteners, mounting points, cables, wiring, connectors, linkages, springs, switches, sensors, moving components, adjustment mechanisms, signs of cracking, bending, corrosion, wear, loosening, overheating, or deformation, and proper operation of the product and the equipment on which it is installed.
Do not use a product that appears damaged, loose, excessively worn, improperly installed, or malfunctioning.
Damaged or defective components should be repaired or replaced before further use.
8. OPERATOR AND USER RESPONSIBILITY
The operator or user remains responsible for safe operation of the equipment on which an Untamed South product is installed.
Untamed South products do not replace the operator's responsibility to maintain control of the equipment, follow applicable laws and regulations, follow manufacturer instructions, operate equipment safely, maintain appropriate situational awareness, use required safety equipment, inspect equipment before use, and respond appropriately to changing operating conditions.
The customer remains responsible for the safe operation of the underlying boat, vehicle, engine, equipment, or other application.
9. HUNTING AND OUTDOOR PRODUCTS
Certain Untamed South products may be intended for hunting, fishing, outdoor recreation, camping, boating, or other outdoor activities.
Customers are responsible for complying with all applicable federal, state, and local laws, regulations, licensing requirements, safety requirements, and landowner restrictions.
Untamed South does not represent that a product is legal for every application, jurisdiction, hunting method, vehicle, vessel, or activity.
The customer is responsible for determining whether the customer's intended use is lawful.
Where a product is intended to be used with equipment that presents inherent safety risks, the customer must follow all applicable manufacturer safety instructions and applicable laws.
10. PRODUCT MODIFICATIONS
Unauthorized modifications to an Untamed South product may adversely affect its operation, reliability, and safety.
Any modification, alteration, substitution of components, or installation method not authorized by Untamed South may void the applicable product warranty.
Untamed South is not responsible for failures or damage resulting from unauthorized modifications, improper installation, misuse, abuse, or use outside the product's intended application, to the maximum extent permitted by applicable law.
11. PRODUCT WARRANTY
Untamed South warrants that its products will be free from defects in materials and workmanship for 2 Years from the date of original purchase by the original purchaser, subject to the limitations and exclusions contained in these Terms.
The warranty applies only to the original purchaser unless otherwise stated by Untamed South.
The warranty does not cover normal wear and tear, cosmetic damage that does not affect functionality, improper installation, improper adjustment, misuse or abuse, unauthorized modifications, use with incompatible equipment, use outside the intended application, accidents or collisions, corrosion or environmental damage beyond the product's intended use, failure to inspect or maintain the product, damage resulting from another component or system, damage resulting from installation of third-party products, damage resulting from use contrary to provided instructions, or any other exclusion permitted by applicable law.
Untamed South's obligation under this warranty is limited to, at Untamed South's option, repair, replacement, or refund of the affected product, subject to applicable law.
12. WARRANTY DISCLAIMER
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EXCEPT FOR ANY EXPRESS WARRANTY SPECIFICALLY PROVIDED BY UNTAMED SOUTH IN WRITING, UNTAMED SOUTH DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.
NO WARRANTY IS MADE THAT AN UNTAMED SOUTH PRODUCT WILL PREVENT AN ACCIDENT, LOSS OF CONTROL, EQUIPMENT FAILURE, PROPERTY DAMAGE, PERSONAL INJURY, OR OTHER LOSS.
Nothing in these Terms is intended to exclude any warranty or consumer protection right that cannot legally be excluded.
13. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNTAMED SOUTH LLC AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE PURCHASE, INSTALLATION, MODIFICATION, POSSESSION, USE, OR INABILITY TO USE AN UNTAMED SOUTH PRODUCT.
To the maximum extent permitted by applicable law, Untamed South's total liability arising from the purchase or use of a product shall be limited to the amount actually paid to Untamed South for the product giving rise to the claim.
This limitation does not apply to liability that cannot legally be limited or excluded under applicable law.
14. RELEASE OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE CUSTOMER RELEASES AND HOLDS HARMLESS UNTAMED SOUTH LLC FROM CLAIMS ARISING FROM THE CUSTOMER'S OWN NEGLIGENCE, MISUSE, IMPROPER INSTALLATION, UNAUTHORIZED MODIFICATION, FAILURE TO INSPECT OR MAINTAIN THE PRODUCT, USE OF INCOMPATIBLE EQUIPMENT, OR USE OF THE PRODUCT CONTRARY TO PROVIDED INSTRUCTIONS.
This provision does not release or limit liability to the extent prohibited by applicable law.
The customer acknowledges that this provision is intended to be conspicuous and specifically brought to the customer's attention before purchase.
15. CUSTOMER INDEMNIFICATION
To the maximum extent permitted by applicable law, the customer agrees to indemnify and hold harmless Untamed South LLC from claims, damages, losses, liabilities, and reasonable expenses arising from the customer's improper installation, misuse of the product, unauthorized modification, use with incompatible equipment, failure to follow installation or operating instructions, failure to inspect or maintain the product, violation of applicable law, or other negligent acts or omissions relating to the customer's use or installation of the product.
This provision does not require the customer to indemnify Untamed South for liability that cannot legally be shifted to the customer.
16. RETURNS AND REFUNDS
Returns are subject to Untamed South's current Return Policy.
Products that have been installed, modified, damaged, or used may be subject to additional return restrictions.
Customers should contact Untamed South before returning a product.
17. PRODUCT COMPATIBILITY
Product descriptions, specifications, compatibility information, and recommendations are provided in good faith based on information available to Untamed South.
Because equipment, boats, engines, vehicles, electrical systems, hunting equipment, modifications, and installations may vary, the customer is responsible for verifying compatibility before purchase and installation.
Untamed South may update product specifications, designs, materials, features, or compatibility information without notice.
18. THIRD-PARTY PRODUCTS AND EQUIPMENT
Untamed South products may be designed for installation or use with equipment manufactured by third parties.
Untamed South does not control the design, manufacture, condition, or operation of third-party equipment.
The customer remains responsible for ensuring that the Untamed South product is compatible with the applicable third-party equipment.
The use of an Untamed South product does not modify or replace the third-party manufacturer's safety requirements or operating instructions.
19. WEBSITE USE
The Untamed South website and its content are provided for informational and commercial purposes.
Customers agree not to use the website for unlawful purposes, attempt to gain unauthorized access to website systems, interfere with website operation, copy or reproduce website content without authorization, use website content to misrepresent Untamed South products, or use the website in a manner that violates applicable law.
20. INTELLECTUAL PROPERTY
All Untamed South trademarks, logos, product names, photographs, graphics, designs, written content, product designs, and other original materials are owned by or licensed to Untamed South LLC unless otherwise stated.
Unauthorized reproduction, copying, distribution, or commercial use is prohibited.
21. ELECTRONIC ACCEPTANCE
By checking the acceptance box during checkout, the customer confirms that the customer has had an opportunity to review these Terms, understands that Untamed South sells products for a variety of applications, understands that certain products may interface with mechanical, electrical, electronic, engine, throttle, ignition, starting, vehicle, marine, hunting, or other systems, understands the importance of proper installation, inspection, maintenance, and operation, agrees to follow all provided instructions and warnings, and agrees to these Terms.
Electronic acceptance is intended to constitute the customer's electronic agreement to these Terms.
22. GOVERNING LAW
These Terms shall be governed by and interpreted under the laws of the State of Georgia, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.
23. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be modified or limited to the minimum extent necessary to make it enforceable, where permitted by law.
The remaining provisions shall remain in full force and effect.
24. CHANGES TO THESE TERMS
Untamed South may update these Terms from time to time.
The version of these Terms applicable to a purchase will be the version presented to and accepted by the customer at the time of purchase.
Untamed South will maintain records of applicable Terms versions where reasonably practicable.
